Healthcare industry gearing up to try to find common ground with Biden

    The Biden administration is starting out in lockstep with every sector of the healthcare industry: All agree that the top priority must be addressing the COVID-19 pandemic, and every other issue is a distant second.

    Major stakeholder groups also share the main goal of President Joe Biden’s healthcare plan of increasing insurance coverage.

    “We are feeling encouraged in these early days with an administration that cares deeply about affordable quality coverage and care for all,” said Ceci Connolly, CEO of the Alliance of Community Health Plans.

    But there is less agreement on how to do so. Several industry heavyweights are working together around the idea of expanding coverage in a manner they see fit. In February, the American Hospital Association, the American Medical Association, the Blue Cross and Blue Shield Association, the Federation of American Hospitals and some other large groups created the Affordable Coverage Coalition. Its goal is to achieve universal health coverage through several steps, including enhancing Affordable Care Act premium subsidies and providing incentives for more states to expand Medicaid.

    Biden’s primary strategy to decrease the uninsured rate of roughly 10% so far has been to re-vitalize the ACA, which the Trump administration had steadfastly chipped away at. A special enrollment period that opened Feb. 15 allows Americans to buy coverage through the ACA marketplaces until May 15, and $50 million will be spent on advertising and outreach to help people seize the opportunity.

    The COVID-19 relief bill, which is expected to be approved by the House this week and then sent to Biden for his signature, would temporarily enhance the premium tax credits for marketplace plans and provide subsidies for those who buy Consolidated Omnibus Budget Reconciliation Amendment—COBRA—coverage after leaving a job.

    The new administration is also making it easier for low-income individuals to access Medicaid coverage, or at least it is returning to the pre-Trump administration baseline. As part of its review of Trump-era regulations, the Biden administration on Feb. 12 announced that it is going to unwind a controversial policy that allows states to force low-income residents to work, volunteer or take part in other so-called “community engagement” activities in order to enroll in Medicaid coverage. CMS also withdrew a 2018 letter from then-Administrator Seema Verma to state Medicaid officials that invited them to apply for the waivers.

    “Both the COVID bill, as well as the executive actions taken by the administration in this area, are very supportive of the ACA framework, and we believe will materially reduce un-insurance at this critical time,” said Chip Kahn, CEO of the Federation of American Hospitals, which represents for-profit health systems. “It’s refreshing for us to have an administration that wants to encourage coverage through the ACA, and we look forward to working toward closing the uninsured gap again.”

    The healthcare coalition members say Biden and the industry are not that far apart. “A number of the provisions that are in the ACC principles were included in Biden campaign announcements as well as alluded to in various executive orders that have been issued so far,” said Kris Haltmeyer, vice president of legislative and regulatory policy for the Blues association.

    Building healthcare equity

    Health equity is a rising priority for many healthcare advocacy organizations, so President Joe Biden’s executive order creating a COVID-19 Health Equity Task Force is in line with recent industry actions.

    In addition to recommending equitable allocation of COVID-related resources and funds, the task force must develop a long-term plan to improve data collection and use regarding communities of color and other underserved populations.

    The Catholic Health Association, representing more than 2,200 healthcare organizations, recently created a Confronting Racism by Achieving Health Equity initiative, and nearly 85% of its members have already committed to initiatives in their communities, said Sister Mary Haddad, the association’s CEO.

    “Our board last summer really became very impassioned, saying, ‘We have to address racism in this country and what can we as healthcare providers do?’ ” she said. “That’s why I was so pleased with the Biden administration coming out talking about health equity right at the beginning.”

    Departure points

    That’s not to say it will be smooth sailing for the administration. Two of Biden’s campaign hallmarks—creating a public option that would allow people to buy into Medicare and reducing the age of Medicare eligibility to 60—face stiff headwinds from trade groups, as well as lawmakers on both sides of the aisle. Larry Levitt, executive vice president for health policy at the Kaiser Family Foundation, noted that it’ll be difficult for the administration to gain much traction on either in a closely divided Congress.

    The AHA and FAH in 2019 commissioned a study, which suggested that a government-run, Medicare-like option would lead to nearly $800 billion in payment cuts over 10 years. At the same time, utilization would grow.

    Nonetheless, during his confirmation hearings in late February, HHS secretary designate Xavier Becerra reinforced Biden’s desire to find ways to expand coverage. “What I will tell you is I’m here at the pleasure of the president of the United States,” Becerra said. “He’s made it very clear where he is. He wants to build on the Affordable Care Act. That will be my mission, to achieve the goals that President Biden put forward, to build on the Affordable Care Act.”

    How hard Biden pushes for these reforms remains to be seen, but Medicare’s pending insolvency could create opportunities for policy discussions on expanding the program, said Dr. David Blumenthal, CEO of the Commonwealth Fund. The Medicare trust fund is projected to have insufficient funds to cover its obligations beginning in 2024. “If the Congress wants to give more people the coverage that Medicare offers, there are ways to fund it—it’s just a matter of finding the political will to do so,” he said.

    Telehealth’s moment?

    On the affordability front, Ashley Thompson, senior vice president for policy at the AHA, is looking for legislation that solidifies telehealth’s role in healthcare delivery.

    “We have seen, during the pandemic, that it makes (healthcare) more affordable and also improves access, especially in rural communities,” she said. “We are going to need help from Congress to remove some of the key barriers in order to make telehealth continue being used as it has during the public health emergency.”

    The AHA is particularly concerned about originating site and geographic restrictions. The CARES Act gave HHS the ability to temporarily waive those limitations on telehealth services covered under Medicare. In normal times, telehealth has largely supported rural health, although beneficiaries had to travel to a healthcare facility rather than do a visit at home. Congressional action is required to permanently remove those barriers.

    “There is incredible bipartisan support for all things telehealth, but there’s a little bit of that old green eye-shade mentality in Washington of, ‘Oh, we think for whatever reason it might add costs,’ ” Connolly said. “We now have been living a real-world experiment for 10 months, and we need policymakers to understand that health plans are coming forward with real insights around cost savings.”

    During a House Energy and Commerce health subcommittee hearing last week, chair Rep. Anna Eshoo (D-Calif.) said it’s time to make telehealth flexibilities permanent, calling many of the payment policies CMS waived amid the public health emergency “outdated.”

    But how to craft new policy is still up for debate. HHS’ Office of Inspector General in late February said it’s conducting “significant oversight work” to assess telehealth services, including fraud, abuse and misuse of such services. And during its January meeting, members of the Medicare Payment Advisory Commission wrestled with the best way to evaluate what’s been accomplished over the past year. Some commissioners, including Paul Ginsburg, health policy chair at the Brookings Institution, suggested that HHS run a two-year pilot on expanding telehealth once the emergency declaration ends.

    Hospital, insurer and employer groups agree on coverage principles

    The Affordable Care Coalition, made up of powerful lobbies representing providers, payers and employers, in February, issued its principles for making health coverage accessible and affordable:

    Tax credits and cost-sharing reductions:
    Increase “the generosity of” and expand eligibility for Affordable Care Act premium tax credits and cost-sharing reductions.

    Insurance affordability fund:
    Establish a sustained federal funding mechanism to support any unexpected high costs for caring for people with serious health conditions or to lower premiums or cost-sharing for exchange enrollees.

    Automatic and facilitated enrollment:
    Automatically enroll and renew individuals eligible for Medicaid and premium-free marketplace plans and facilitate enrollment for any remaining uninsured.

    Federal funding for outreach and enrollment:
    Urge Congress to increase funding for navigator, outreach and enrollment programs and encourage states to develop more efficient and less costly outreach and enrollment platforms.

    Incentives to close the low-income coverage gap:
    Ensure everyone with an income up to 138% of the federal poverty level has comprehensive coverage. Congress should again fund a three-year, 100% federal match for states that haven’t expanded Medicaid.

    Preventing increases in the uninsured:
    Policymakers should help prevent Americans who have lost, or are at risk of losing, employer-provided health coverage from becoming uninsured. That could be done by temporarily covering the cost of continuing health coverage through the crisis, such as through COBRA subsidies or direct loans to employers. For people who have lost coverage, it could be done through automatic enrollment into Medicaid, the Children’s Health Insurance Plan and ACA marketplace coverage.

    Drug prices

    There is also bipartisan support—and support among major stakeholder groups—for Biden’s campaign pledge to address prescription drug prices, said Dan Jones, AHCP’s vice president of federal affairs. Among other things, Biden has advocated for limiting drug price increases to no more than the rate of inflation.

    But any “government price setting” is a bright line that the drug industry is unwilling to cross, said a representative of the Pharmaceutical Research and Manufacturers of America. The drug industry’s role in combating the COVID pandemic may give it sufficient political power to thwart even a bipartisan consensus on curtailing drug-cost escalation, Kaiser Family Foundation’s Levitt said.

    “They may be the heroes that get us out of this with the vaccines,” he said on the “A Second Opinion” podcast. “And it may be politically a little more difficult to go after the industry than it otherwise might have been.”

    Workforce development

    The pandemic has severely strained America’s healthcare workforce, and advocates hope that will spur bipartisan support for action. The COVID-19 relief bill passed in December authorized Medicare to fund 1,000 additional physician residency slots, lifting the cap on residency positions set by a 1997 law. The Association of American Medical Colleges, which predicts a shortage of up to 139,000 physicians by 2033, sees an opportunity to build on that.

    “If you talk to the legislators, they recognize that is only a start, but it was an important recognition of the need to release that freeze,” said Karen Fisher, AAMC’s chief public policy officer.

    Beyond physicians, Biden’s COVID-relief plan provides funding for 100,000 public health workers. Carrie Cochran-McClain, vice president of government affairs and policy at the National Rural Health Association, hopes that signals that healthcare workforce development will be a priority for the administration.
