The FTC under Khan’s leadership has strengthened its track record as an entity working to interrogate potentially anticompetitive company actions. This year, the agency rolled out a final rule to amend a form that has not been updated in nearly five decades. Under the rule, health systems pursuing combinations will be required to list acquisitions that have occurred within the previous five years, disclose private equity and minority stakeholders, and explain shared supplier relationships. The agency has additionally fought to defend its ban on most noncompete agreements — which could have an enormous ripple effect on the healthcare industry — and filed an administrative complaint against the country’s three largest pharmacy benefit managers. It also successfully challenged Novant Health’s proposed acquisition of two North Carolina hospitals from Community Health Systems.
