New York Presbyterian/Columbia University Medical Center charged a 71-year-old patient $2,694 for the release of her electronic health records, according to her lawyer. The charges were based on a payment rate of $1.50 a page, the suit alleges.
That's double the $0.75 per page rate limit set by New York and a violation of state law, attorney Lowell Sidney said. Sidney has filed a class-action suit against the hospital and IOD Inc., of Green Bay, Wis., a document management vendor that provided release of information services for the hospital.
The suit contends through the plaintiffs' “wrongful and unlawful conduct” they've received “substantial profits and windfalls” and have been “unjustly enriched at the expense of plaintiff and members of her class.” The suit seeks unspecified damages.
