A federal judge dismissed most of a lawsuit filed by pharmacy groups to block Express Scripts' acquisition of Medco Health Solutions but allowed a claim regarding clinical specialty drugs to stand.
The National Association of Chain Drug Stores, the National Community Pharmacists Association and nine retail pharmacy companies sued in March in the U.S. District Court for the Western District of Pennsylvania, alleging the $29 billion deal combining two of the three largest pharmacy benefit managers was anti-competitive.
The suit was filed days before Express Scripts and Medco closed the acquisition.
In the Aug. 27 ruling, Judge Cathy Bissoon dismissed most of the groups' claims, including claims relating to the market for large employers. The plaintiffs can file an amended complaint by Sept. 10.
