There is really one good way to reduce malpractice claims and the fear of lawsuits.
If a physician can document that he/she was following a nationally recognized, peer-reviewed evidence-based guideline, then there needs to be automatic immunity from lawsuits.
That gets away from the “fear of litigation” arguments. Recently a study stated that 91% of physicians say they order tests to cover themselves. I really do not think the impact of unnecessary testing is minimal. My personal belief is that the numbers are huge.
