It was the second time the plaintiff's side went after the physician after they paid the $1 million policy cap. It is outrageous that we, as physicians, have to accept such high-risk monetary damages for relatively modest payments of service. For example, an obstetrician may get paid for total OB services in the amount of $2,500, but can be sued for $25 million.
I understand we should all be responsible for our actions, but we should not lose everything for one mistake—if it is really a mistake or just an error in judgment that hindsight brings clarity to the situation. To this end, all physicians in all fields understand this issue and therefore over test to cover all bases and try to leave nothing to question in an untoward event.
