The Obama administration has directed federal agencies to review regulations issued over the past decade to see if federal pre-emption of state law is legally justified, according to a memo issued by the White House. Business groups have long called for federal pre-emption of some state laws, including product liability laws, arguing they hindered business. The Bush administration backed federal pre-emption of state laws affecting some federally regulated products, such as medical devices.
