The Kansas Supreme Court has blocked a grand jury from obtaining medical records from physician George Tiller, who is accused of performing illegal late-term abortions.
Chief Justice Kay McFarland wrote in the opinion that the subpoena for Tillers records raises significant questions regarding the extent and scope of a judges role in grand jury proceedings, a grand jurys authority to issue subpoenas and privacy protections to be afforded medical patients records.
A public petition to the 18th Judicial District Court in Sedgwick County convened the grand jury investigating Tiller, whose Wichita clinic was bombed in the 1980s and who was shot in 1993. -- by Gregg Blesch
