Evanston (Ill.) Northwestern Healthcare said it will appeal an administrative law judge's finding that could force the three-hospital system to divest Highland Park (Ill.) Hospital. Federal Trade Commission Administrative Law Judge Stephen McGuire ruled that the 2000 merger between Evanston Northwestern and Highland Park violated Section 7 of the federal Clayton Act, substantially lessening competition and raising healthcare prices. Evanston Northwestern President and Chief Executive Officer Mark Neaman said the system will appeal the decision to the full commission and to federal court if necessary. If upheld, McGuire's decision would result in one of the few ever court-ordered breakups of a hospital merger. -- by Mark Taylor
