A Georgia judge tossed out uninsured billing lawsuits brought by Richard Scruggs' legal consortium against Phoebe Putney Health System and Phoebe Putney Memorial Hospital Monday. Georgia Superior Court Judge John Harvey dismissed the two uninsured-patient billing lawsuits "with prejudice," or on their merits. Harvey is the first judge to dismiss Scruggs' state lawsuits with prejudice. Karen Snyder, a spokeswoman for the Albany, Ga., health system praised the ruling, saying "We've maintained from the beginning that the lawsuits were baseless." Bryan Vroon, an Atlanta attorney in Scrugss' consortium said he is disappointed and will appeal the ruling. -- by Melanie Evans
