Richard Scruggs' consortium sued three Milwaukee-based systems in state court, alleging Aurora Healthcare, Covenant Healthcare System and Froedtert & Community Health overcharge uninsured patients and used "aggressive, abusive and humiliating collection practices." The class-action lawsuits in Milwaukee County Circuit Court seek an injunction to create a trust for uninsured patients. The trust would hold the defendants' savings from their tax-exempt status; profits from caring for uninsured patients; the difference between what uninsured patients and health plans pay; and enough assets and revenue to provide affordable medical care for the patients covered by the suits. All three systems denied the allegations and defended their charity care. "We are gong to fight the suit vigorously," a Froedtert spokeswoman said. -- by Melanie Evans
