LifePoint Hospitals, Brentwood, Tenn., settled its federal lawsuit against Wythe County Community Hospital, Wytheville, Va., and Carilion Health System, Roanoke, Va., clearing the way for LifePoint to complete its purchase of WCCH. LifePoint reached a $56 million asset purchase agreement with WCCH in November 2004 and sued when Carilion exercised the right of first refusal to purchase the hospital. LifePoint argued that WCCH breached its agreement with LifePoint because Carilion's offer was not equivalent to LifePoint's in respect to information systems. LifePoint still needs approval by the Virginia attorney general's office to complete the purchase and no closing date has been set, said Mark Pickrell, a lawyer representing the company. Other terms of the settlement are confidential, Pickrell said. Carilion confirmed the settlement in a statement, saying that "the possibility exists for developing mutually beneficial relationships for certain business lines in the future between Carilion and LifePoint." -- by Vince Galloro
