Jury selection is scheduled for Jan. 5, 2005, in the federal fraud case against Richard Scrushy, founder and former chief executive officer of HealthSouth Corp., Birmingham, Ala., according to documents filed in U.S. District Court in Birmingham. A pretrial conference is scheduled for Nov. 29. The government has charged Scrushy with 85 criminal counts in connection with a multibillion-dollar accounting fraud at HealthSouth. Federal Judge Karon Bowdre earlier this year said the trial would start this September or in January 2005, depending on schedules. The case has been postponed from previous scheduled starts in January, February and August of this year because lawyers said they needed more time to prepare and because of a scheduling conflict. U.S. Attorney Alice Martin, the lead federal prosecutor, said the court chose the later date because of previous scheduling conflicts, and that there could be further delays. -- by Joseph Mantone
