A District Court judge in Idaho Falls, Idaho, refused to dismiss a complaint brought by four physicians against HCA, Nashville, and HCA's Eastern Idaho Regional Medical Center.
The physicians say their staff privileges at Eastern Idaho are being threatened illegally because they are investors in competing, for-profit Mountain View Hospital, which opened in late 2002 as a multi-surgery center. Judge Richard St. Clair of the 7th Judicial District in Bonneville County denied a motion by HCA and Eastern Idaho to dismiss the complaint.
The hospital initially told the physicians that their staff privileges would be revoked in March. After the physicians filed their complaint, hospital officials promised not to take action until the hospital board meets in September.
The physicians say the threat to their privileges is an attempt to thwart competition in the Idaho Falls market.
