Tenet Healthcare Corp., Santa Barbara, Calif., has challenged the constitutionality of a new Florida law waiving certificate-of-need oversight for open-heart surgery programs. The challenge was filed Monday in Leon County Circuit Court in Tallahassee, hours after Gov. Jeb Bush signed the law. A spokesman for the governor said the law immediately opens the way for new open-heart surgery programs at six hospitals. The law also exempts bed expansions at existing facilities from CON and bans licensure of single-specialty hospitals. Tenet operates 15 hospitals in Florida. -- by Michael Romano
