A North Dakota judge dismissed the state's lawsuit against Banner Health System, Phoenix. The lawsuit, filed last year by Attorney General Wayne Stenehjem, sought the proceeds from Banner's sale of a hospital and five nursing homes, contending that Banner had an implied trust agreement with the state as a not-for-profit operator. But Cass County District Court Judge Georgia Dawson ruled that the state did not support its argument that Banner held its assets in trust for the benefit of the communities. Banner left behind about $17.8 million in charitable assets from nursing homes and the Anne Carlsen Center for Children in Jamestown, N.D., a spokesman said. -- by [email protected]
