Select Medical Corp., Mechanicsburg, Pa., said it received notice yesterday that the U.S. Justice Department has decided not to intervene in a 4-year-old whistleblower lawsuit alleging that Select Medical rehabilitation clinics acquired from NovaCare had wrongly billed group therapy sessions as individual sessions. The lawsuit was filed under seal in August 1998. Select Medical learned of the suit shortly after signing an agreement to purchase NovaCare's physical rehabilitation and occupational health division in October 1999, said Michael Tarvin, the company's senior vice president and general counsel.
