The Alabama Hospital Association filed a friend-of-the-court brief in support of two hospitals' effort to overturn a certificate-of-need exemption for a $240 million HealthSouth Corp. hospital under construction in Birmingham. The state Legislature granted the exemption last September for the "all-digital" hospital. Not-for-profit Baptist Health System and Tenet Healthcare Corp.'s Brookwood Health Services, both in Birmingham, contend the exemption violates the state constitution. In its amicus brief, the Alabama Hospital Association said the exemption is "not only unfair . . . but is simply unsound policy." Arguments are scheduled to begin July 16. -- by Julie Piotrowski
