A three-judge appellate court panel won’t revisit its March ruling that overturned the criminal Medicare fraud convictions of two former executives with Columbia/HCA Healthcare Corp., now HCA. The U.S. attorney in Tampa, Fla., had asked the three-judge panel of the 11th U.S. Circuit Court of Appeals in Atlanta for a rehearing on the ruling, which overturned the 1999 convictions of Jay Jarrell, 46, and Robert Whiteside, 51. The judges denied the request in a one-line order, according to court records. A spokesman for the U.S. attorney’s office said prosecutors knew of the order but had not yet received a copy from the court and would not comment until they reviewed it. Prosecutors could ask the full 11th Circuit to review the ruling, or they could appeal the panel’s decision to the U.S. Supreme Court.
