While reading your Aug. 11 article on state certificate-of-need programs ("CON survival struggle," p. 32), I noticed an error regarding New Jersey's CON requirements for subacute care.
The state has three levels of CON: full review (by local and state boards and then the commissioner of health); direct review (by the state board and then the commissioner of health); and expedited review (by the commissioner of health only).
Your chart shows subacute care as unregulated in our state. While it's subject to the least-stringent type of CON, it is indeed regulated and has been the subject of great controversy among New Jersey hospitals, the commissioner of health and HCFA.
