The Centers for Medicare & Medicaid Services, a branch of HHS, oversees the Medicaid programs offered by each state as well as administers the Medicare program. President Barack Obama used a recess appointment last summer to name Dr. Donald Berwick as CMS administrator, though after a letter signed by 42 Republican senators urging his permanent nomination be withdrawn, his future with the agency is up in the air. Key responsibilities of the CMS include development of rules and regulations to implement provisions of healthcare laws, such as the administrative simplification standards from the Health Insurance Portability and Accountability Act (HIPAA) and the various sections of the Patient Protection and Affordable Care Act.
