Intriguing. State licensing authorities might question whether recovery audit contractors' determining whether particular services are medically necessary is in fact “practicing medicine.”
There is much precedent that would suggest that in the past, such decisions have been considered “the practice of medicine.” Will the CMS actions trump states' police powers to regulate medicine?
